Whitehaven coalmine legal challenge briefing

West Cumbria Mining Ltd want to build a new coalmine just south of Whitehaven. The Secretary of State for Levelling Up, Housing and Communities, Rt Hon Michael Gove MP (the "SoS") granted planning permission for this mine on 7 December 2022.

Friends of the Earth and South Lakes Action on Climate Change have both filed cases against the SoS to challenge this decision, as we believe it was unlawful as the SoS did not properly consider the climate impacts of this mine. If this mine goes ahead, it will be the UK’s first new deep coal mine for 30 years and produce millions of tonnes of coal at a time when scientists have just delivered the starkest warning yet about the climate crisis.
